Washington's Public Records Act (RCW 42.56) gives advocates, attorneys, and watchdog organizations a statutory right to the placement records, missing child reports, and case notes DCYF controls. This guide shows how to use it.
What a PRR can force DCYF to produce.
RCW 42.56 applies to all DCYF records. Agencies frequently underrespond or delay. Knowing exactly what to request and how to escalate changes the outcome.
Placement history
- Every authorized and documented placement change for a specific child
- Unapproved residence addresses logged by caseworkers
- Safety assessments (or the absence of them) at each placement
- Supervising caseworker assignments and handoff dates
Missing child reports
- NCMEC Missing-from-Care reports filed (and not filed) for each incident
- Law enforcement notification logs and response times
- Prior runaway incidents and whether protocol was followed
- Return-to-care documentation and follow-up safety plans
Case notes and internal communications
- Caseworker visit notes and contact logs
- Supervisor review records and approval chains
- Internal escalation emails when protocol failures occurred

RCW 42.56.080 gives DCYF five business days to respond. Most advocates don't track this deadline precisely. When it passes, escalation rights open — and most advocates miss them.

PRR submitted
Submit in writing. Reference RCW 42.56.080. Keep the timestamp.
Day 5
Agency must respond
Acknowledge, produce records, deny with legal basis, or request extension. Silence is a statutory violation.
Day 6+
Escalation window opens
File with WA superior court under RCW 42.56.550. Courts award attorneys' fees and daily penalties.

If DCYF fails to respond within five business days, you may file a complaint directly with the superior court. The court may order immediate record production, award attorneys' fees, and assess daily penalties against the agency. Documenting the exact submission timestamp and the silence that follows is the entire case.

Re: Public Records Request — RCW 42.56 To the DCYF Public Records Officer: Pursuant to Washington's Public Records Act, RCW 42.56, I request copies of the following records relating to [CHILD'S INITIALS OR CASE NUMBER], date of birth [DOB], for the period [START DATE] through [END DATE]: 1. All placement records, placement change notifications, and documented addresses where the child was located or residing. 2. All Missing-from-Care reports filed under 42 U.S.C. § 13014 and corresponding law enforcement notifications. 3. All caseworker contact logs, visit records, and case notes during the specified period. 4. All internal communications, emails, or escalation records relating to any unapproved placement or runaway incident during the specified period. 5. All safety assessments completed at each placement address during the specified period. I am prepared to pay reasonable copying fees. Please provide records in electronic format where available. If any records are withheld, please identify the specific statutory exemption and the number of pages withheld. RCW 42.56.080 requires a response within five business days. Please confirm receipt of this request.
